Topic: Utilities - non payment
The tenants utilities are in my name and they are not being paid. I have a stipend amount that is covered in the lease anything over that amount they are to pay. We are currently have an eviction court date. Can I legally turn off the utilities?

Hello I have some renters in my home that were to put the utilities in their name and didn't. Now I have a bill of over $500.00 and they are shuting off the power. The renters called the police and the police came out and arrested me because I didn't pay the bill. Can they get away with that? I am not going to pay their bill. They are not even paying the rent and they have now done about $50,000 in Damages and I always get from the ploice that I have no rights. Help!

I am just going through this and have done alot of research. The KEY is to think in your mind what is reasonable and fair. In my case, we did not have the
clause in the lease to pay the excess. But you can notify to the tenant within 30days to amend the lease
that includes switching the utilities into their name. Notify the power company that you have given permission to have Mr. XXXXX assume the utilities. On day 31, SHUT IT OFF. Michigan Utility companies and I am sure GA have a Legal Department. Speak with them and they will make sure you are within GA law. Good Luck.
