Topic: Tennant would like to be removed off of lease
I have situation where an unmarried couple are breaking up and one party would like to be removed off the a 1 year lease while another party would be available to replace in order to fullfill the obligation of the lease. Do I need to terminate the original lease and draw up a new lease or do can we generate an addendum that indicates we are removing one party and adding a different tenant? The current lease does not allow for subletting.

If I were you, If there is another person to replace the move out party, I want to have another lease signed. Otherwise, I will leave both of their names in so that if the remaining party cannot pay you, you will have two persons to pay for the non payments.
