I let the tenant move in before returning a signed lease. I am requiring a standard Nebraska lease, for a term of six months. The tenant has been in for just over one month, and now is having problems paying rent. I am fearful the tenant isn't planning on signing the lease because they don't want to be held for the full amount due for the term of the lease. Am I still required to give 30 days notice for eviction, even though a signed lease was part of the original agreement?

| I don't know what the law is in Nebraska,but in Pennsylvania without a signed lease,it's automatically month to month.You're supposed to give them 30 days written notice to vacate the property.You don't need a reason,without a lease.A signed lease would protect you and the tenant.You're right,if they're having trouble paying the rent then they'll probably not sign the lease.Hopefully,they'll move out without a lot of extra expenses for you.I had a tenant sign a 1yr.lease,then she moved out because she said that she couldn't afford the rent.The local magistrate told me that it would cost me to get her evicted,and even if I won the case-they couldn't force her to pay if she didn't have the funds.He also told me that a lease is only as good as the person signing it,in other words if the tenant doesn't care about their credit or have money,then you're out of luck.Hopefully,your tenant will move without living there rent-free.You could tell them that you have a family member that needs to move in there,or you'll be selling the property soon.Good Luck! | |
