Topic: DO I need to use a lawyer?
I'm trying to sell my building and I'm not sure if I need to hire a lawyer to help with the closing. Has anyone have a point of view on this?

I am a lawyer (hence the long answer:), and I get all kinds of calls from acquaintances thinking they need a lawyer to sell a home. This is like NEEDING an ace mechanic to change your oil. (In which case I would ask "Is it a Subaru or a Lear Jet?") What kind of building? What experience do you have in real estate? Do you have a realtor? Is this a simple "get a loan and give me cash" deal, or is there creative financing involved? Answer these questions and you'll be able to decide for yourself. Also, a word of caution--folks always call and ask me to attend closing AFTER they have signed the purchase agreement and the deal is set in stone. Unless your commitment is "subject to attorney approval," all I can do at closing is drink coffee, verify that the closing costs match your contract, and send you a bill. The janitor at the title company can probably do this for less money....

Not Necessarily. My mother sold her duplex last year in Nevada--each tenant had a month to month and she and the buyer agreed to roll over the lease--she also sent the tenants a letter giving them the new information and introduced the tenants to the buyer. Also--all rental deposits were discounted from the purchase price and clause was included in the contract---so long as you have a real estate agent and maybe one w/experience in retal purchases you will be fine.

I have always used a lawyer to go over any contracts and He has always saw things that I wouldn't have seen and asked for things that I wouldn't have asked for. Very good.

I agree!! Definitely use a lawyer the $100 - $300 cost of an attorney is well worth the piece of mind you will get. Besides, if you don;t use an attorney and you make a mistake it could cost you thousands or even tens of thousands. Get a lawyer!!

Defenitely use a lawyer. He will be the only to prepeare all the documents for this transaction. It is a little complex this not like selling a car where you only hand the title.
